Terms and Conditions

Tokyo Toybox reserves the rights to:

  • Withdraw and cancel services, and make financial transactions.
  • All verbiage and events.
  • All images, all artwork of Bento the Dragon (our mascot), and the name "Tokyo Toybox".
  • Set rules for user behavior, like forbidding unlawful behavior, hate speech, bullying, promotions, spam, etc.
  • Disable user accounts.
  • Having final say in all matters related to "Tokyo Toybox".

Be Safe

  • Follow all event policies, venue rules, and staff directions.
  • No running, jumping, throwing, or other unsafe shenanigans.
  • Support each other in maintaining a safe environment.
  • Report concerns to Tokyo Toybox staff (wearing orange Tokyo Toybox jerseys) or volunteers.

Play Nice

  • Don’t harass other attendees, staff or vendors.
  • Respect everyone's physical, social boundaries and their personal property.
  • No stealing, cheating, trolling, or griefing.

Have Fun

  • Remember to eat, sleep and shower.
  • Make a friend.
  • Play some games.
  • Explore.

Everyone should observe common sense rules for behavior, personal interaction, courtesy, and respect. Harassing or offensive behavior will not be tolerated. Tokyo Toybox reserves the right to revoke, without refund, the Event Registration, Neoparty Pass or admission of any participant not in compliance with this policy.


Anti-Harassment Policy

Tokyo Toybox is committed to providing a safe environment where everyone is treated with dignity and respect. Harassment or unwelcome conduct, whether verbal, physical, visual, or in any other form, is strictly prohibited. Tokyo Toybox’s anti-harassment policy applies to all persons involved in the operation or attendance of any Event, not just “Neoparty”. Tokyo Toybox will not tolerate harassment of anyone by anyone, including participants, vendors, hosts, or Tokyo Toybox staff.

Tokyo Toybox defines harassment as any behavior that threatens a person or group or produces an unsafe and non-inclusive environment. Harassment includes, but is not limited to, offensive verbal comments or non-verbal expressions related to gender, gender identity, gender expression, sexual orientation, disability, physical appearance, body size, ethnicity, age, or religious beliefs.

Furthermore, harassment includes, but is not limited to, sexual or discriminatory images in public and quasi-public spaces (online and offline), intimidation, stalking, following, harassing photography or recording, sustained disruption of talks or other events, inappropriate physical contact, and unwelcome sexual attention. Harassment may take the form of comments, epithets, slurs, discriminatory or insensitive jokes, teasing, display or discussion of written or graphic material, repeatedly standing too close to or brushing up against a person, or giving gifts of an unwanted or sexual nature. Advocating or encouraging any of the above is also considered harassment.

Harassment at Tokyo Toybox and any of Tokyo Toybox’s Events does not include respectful disagreement or critique offered in good faith. Tokyo Toybox reserves the right to alter or broaden its definition of harassment at its sole discretion.

No one should tolerate any conduct of this type. Should you experience or witness harassment, you may choose to take any of the following actions:

  1. If you feel safe and comfortable doing so, ask the offender to stop. Whether the offending behavior is intentional or unintentional, expressing your discomfort to the offender directly may put a stop to that conduct.
  2. Leave the area. While this may seem unfair, it is sometimes best for your safety and well-being if you leave the area, especially if you feel uncomfortable around the offender or their conduct. After separating yourself from the conduct, you may wish to take additional actions.
  3. If you are comfortable doing so, ask a Tokyo Toybox staff member or volunteer or on-site security for help. You can find Tokyo Toybox staff (wearing orange Tokyo Toybox jerseys) behind the front counter, walking the event, running booths and tournaments, and roaming the halls.
  4. Report the incident formally to Tokyo Toybox, on-site or online. You may go to a Tokyo Toybox staff member to file an incident report in person. This can also be done anytime during or after the event by emailing Neoparty@TokyoToybox.com for issues during Neoparty or Joe@TokyoToybox.com for other Events.
  5. Contact the police or other appropriate authorities. Your health and safety are our most important concern. If you require immediate assistance from law enforcement, medical services, or other governmental entities, please do not hesitate to contact such services directly.

Based on any informal or formal complaint or report of harassment, Tokyo Toybox may take the following steps. Note that this list is not exhaustive, and other appropriate action may be taken as necessary.

  1. Read and investigate all reports. Tokyo Toybox documents and reviews all reports. Reporting parties may be contacted for further clarifying information, unless they have submitted a report anonymously or asked to not be contacted further. Note that Tokyo Toybox will not share the results of these reports with anyone, including the person who filed the report, unless required by law.
  2. Intercede if and when appropriate. Tokyo Toybox staff may take immediate action to address harassment concerns, including but not limited to, escorting participants to a location in which they feel safe, refunding tickets, cancelling events, moving event locations, requesting participants leave a specific area, removing offenders from the event, or banning offenders from the Event. Bans and removals may be on a temporary basis, for the duration of the Event, or permanent.
  3. Contact police and medical authorities when appropriate. If, upon review, Tokyo Toybox finds that relevant local government officials should be notified, Tokyo Toybox may contact such entities and/or share confidential information as required by law.
  4. Sanction participants based on our investigations. Tokyo Toybox Event participants found to have violated the Code of Conduct may be subject to sanctions, including but not limited to:
    • Verbal or written warning
    • Requiring the participant to avoid any interaction with, and physical proximity to the party or parties involved
    • Temporary suspension from any Tokyo Toybox sponsored events or online services
    • Permanent ban from any Tokyo Toybox sponsored events or online services
    • Immediate expulsion from the convention without refund
    • Reporting of the incident to the appropriate authorities

Tokyo Toybox's Code of Conduct applies in all physical and online spaces within Tokyo Toybox's control. This includes, but is not limited to, event venues, Pop-Up Tokyo Toybox locations, Tokyo Toybox social media pages, streamed programming, and Tokyo Toybox forums. Occasionally Tokyo Toybox is made aware of behavior by participants (or potential participants) that has occurred outside of Tokyo Toybox and our Events — either online or offline — and is a gross violation of our Code of Conduct. These actions need not occur in Tokyo Toybox-affiliated spaces to be considered for sanctions by Tokyo Toybox. These include, but are not limited to:

  • Individuals who have not attended Tokyo Toybox Events but have a history of abusive behavior and/or known incidents that took place outside Tokyo Toybox and our Events that may cause risks to a participant’s safety, or which may contribute to a hostile or non-inclusive environment at the convention
  • Tokyo Toybox Event participants who have been reported for outside incidents, including, but not limited to, conduct at other conventions, meetups or stores, threatening or abusive behavior online, or assault

We understand that, at times, participants will have disagreements or interpersonal conflicts that do not necessarily escalate to the point of harassment or abuse. Tokyo Toybox will not arbitrate such disagreements—we ask that you please leave these conflicts at home.

Tokyo Toybox Events (Including “Neoparty” ) Terms of Service

 

All participants in Tokyo Toybox LLC's ("Tokyo Toybox" or “Us/We") Events (including “Neoparty”) ("Events") are required to, and hereby do, assume all risk of participation in the event by accepting this terms of service agreement ("Agreement") and the assumption of risk and release of liability described below. Tokyo Toybox, all Events held by Tokyo Toybox, and the event called “Neoparty” are collectively referred to as the "Event(s)".

By purchasing a Neoparty Pass, admission to an event, or otherwise participating in the Events, you agree to be bound by this Agreement:

Waiver/Assumption of Risk/Release of Liability

You agree to assume all risks of participating in the Events and release Tokyo Toybox, staff, and ownership from any liability for loss, damage, or injury (including illness, disability or death) to your person and property while attending, participating in, or becoming involved with the Events. You specifically make the following representations and assurances to Tokyo Toybox, acknowledging that Tokyo Toybox would not permit your participation in the Events without receiving such representations and assurances:

By agreeing to this Agreement, you acknowledge that you wish to participate in a Tokyo Toybox Event subject to the terms and conditions herein. You acknowledge and agree that the Event involves some inherently dangerous activities. Tokyo Toybox will use good faith efforts to conduct and manage the Event, but you understand that it is not possible to make the Event completely safe. You warrant and represent that you are sufficiently knowledgeable, skilled, and/or informed regarding the Event to properly and fully judge the inherent risks of the Event.

You further acknowledge and agree that the Event involves potential risks of serious personal injury, disability, illness, or even death. You represent that you have sufficient physical fitness to participate in the Event and you have no medical reason or impairment that might otherwise prevent you from participating in the Event. If you know or should know of any condition or problem that might prevent you from safely participating in the Event, you agree that you will immediately advise Tokyo Toybox and remove yourself from the Event.

In consideration of being allowed to attend, participate in, or become involved with the Event, you hereby assume full responsibility for your own safety (including online safety) and accept all known and unanticipated risks of loss, damage, and injury (including illness, death or disability) to yourself and your property while attending, participating in, or becoming involved with the Event, regardless of whether or not such risks are attributable to the negligence of others. By assuming and accepting all known and unanticipated risks, you completely absolve, waive, discharge, and release Tokyo Toybox and all its employees, advisers, consultants, members, contractors, organizers, operators, volunteers, sponsors, or other persons affiliated with Tokyo Toybox and all facility staff, guests, fellow participants, landlords, owners, management companies and the like (collectively the "Indemnified Parties") from any legal duty for your safety or any liability for your harm, to the maximum extent permitted by law.

In consideration of being allowed to attend, participate in, or become involved with the Event, you hereby agree to release, waive, discharge, hold harmless, defend, and indemnify the Indemnified Parties from and against any and all liability, claims, demands, controversy, lawsuits, or possible causes of action ("Claims") that may accrue or arise from any loss, damage, or injury (including illness, death or disability) to your person and property that is in any way related to or arising in connection with your attendance at, participation in, or involvement with the Event, regardless of whether or not such Claims are attributable in whole or in part to any act, omission, or negligence of the Indemnified Parties. You agree that the Indemnified Parties will not be legally responsible for any loss, damage, and injury (including illness, death or disability) to your person and property arising out of or in any way connected to the Event, however caused and on any theory of liability whatsoever (whether in contract, tort, negligence, strict liability, or otherwise), including but not limited to the Indemnified Party's own negligence. Such defense and indemnification shall include all reasonable costs, expenses, and attorney's fees that may be associated with any Claims. You further agree that you will not cause, encourage, promulgate, support, or cooperate with (unless such cooperation is judicially mandated) any Claims to be brought against the Indemnified Parties.

You understand that the above release and assumption of risk is intended to provide a comprehensive release of liability but is not intended to assert any defenses that are prohibited by law. The release and assumption of risk shall be enforceable to the fullest extent allowed by law. If any portion of the release and assumption of risk is held invalid, those parts that are not held invalid shall continue in full force and effect. The terms of the above release and assumption of risk shall apply to and be binding on yourself, your spouse, your heirs, all members of your family, executors, administrators, representatives, and assigns.

General Provisions

You understand this Agreement is a binding contract that supersedes any other agreements or representations and is intended to provide a comprehensive release of liability but is not intended to assert any defenses which are prohibited by law. The invalidity or unenforceability of any provision of this Agreement shall not affect the validity or enforceability of any other provision. The parties hereby irrevocably and unconditionally consent to submit to the exclusive jurisdiction of the Henderson County Courthouse or the US District Court - Asheville: Located at 100 Otis Street, Asheville, NC 28801, which is part of the Western District of North Carolina any actions, suits, or proceedings arising out of or relating to this Agreement and irrevocably and unconditionally waive any objection to the laying of venue of any action, suit, or proceeding arising out of this Agreement. The parties hereby irrevocably waive all rights to trial by jury in any action, proceeding, or counterclaim (whether based on contract, tort, or otherwise) arising out of or otherwise relating to this Agreement.

Exploitation of Name and Likeness

In consideration of being allowed to participate in the Event, you hereby agree that Tokyo Toybox may photograph and/or record your likeness and/or voice and your participation in the Event and without any additional consideration, you hereby agree that Tokyo Toybox and its assigns and/or licensees may distribute, exhibit, broadcast, exploit, advertise, publicize, and promote your name, biographical material, likeness, voice, and performance in and in connection with the Event or other Tokyo Toybox events. You further agree that Tokyo Toybox may edit your appearance therein and you waive any personal or proprietary rights with respect thereto. You represent and warrant to Tokyo Toybox that you have not made any contract or commitment in conflict with this grant of rights to Tokyo Toybox. Nothing herein contained shall obligate Tokyo Toybox to make or cause to be made any broadcast or other use of said appearance, or to exercise any of the rights granted to Tokyo Toybox herein.

Code of Conduct and Anti-Harassment

You understand that Tokyo Toybox is dedicated to providing a safe, enjoyable, and harassment-free Event experience for all participants and workers, and you hereby acknowledge that disruptive behavior, inappropriate and unlawful conduct, or harassment in any form will not be tolerated. You agree to conduct yourself, and any minors under your supervision, in accordance with Tokyo Toybox's published Anti-Harassment policy found in this document at https://tokyotoybox.com/terms-and-conditions or at another URL as may be updated from time to time.

Media Usage

  • Media recording equipment larger than a handheld device is allowed only with prior consent of Tokyo Toybox. 
  • Attendees may not block aisles or walkways, impede movement, or disrupt the Event for photo-taking or recording purposes.
  • Media recordings of specific exhibitor booths, on-sale products, demo products, and specific Tokyo Toybox events are prohibited without the consent of the associated exhibitor or event organizer/GM. Attendees are responsible for knowing and complying with any additional rules and regulations pertaining to their location of recording.
  • Tokyo Toybox's Code of Conduct and Anti-Harassment policy extends to photos, recordings, and acts of recording taken by attendees at all Tokyo Toybox Events, Neoparty & Tokyo Toybox. Attendees acknowledge that their photos and recordings must comply with Tokyo Toybox's Code of Conduct and Anti-Harassment policy, and that a failure to do so may result in expulsion without refund from the Event. All policies of Tokyo Toybox are enforced at Tokyo Toybox's sole discretion.
  • Tokyo Toybox, the Tokyo Toybox logo, and Bento the Lucky Dragon are trademarks of Tokyo Toybox LLC. All rights reserved. Use of these marks without express written consent from Tokyo Toybox LLC is prohibited.

Lost Event Passes

  • Lost Neoparty Passes, “Stamp Cards”, Event Cards, Admission Cards, or any physical representation of Event Admittance cannot be replaced if lost or stolen.
  • The unauthorized resale or attempted resale of these passes is prohibited and will result in a forfeiture of the pass(es) without compensation. Each pass must be used by the same person for the entire day of the Event. Passes that have been sold or provided by anyone other than Tokyo Toybox will not be honored. All passes are the property of Tokyo Toybox and must be relinquished to Tokyo Toybox upon request.

General

We strive to make Tokyo Toybox, all Tokyo Toybox Events, and Tokyo Toybox’s “Neoparty” accessible to everyone, but due to health and safety concerns, we must impose certain restrictions. Therefore, you cannot participate in the Event if:

  • You are prohibited from participating in the Event under applicable laws.
  • You are a convicted sex offender.
  • You are under the influence of an illegal drug and/or attempt to sell/distribute any illegal substances or items.
  • You are intoxicated in any way.

We reserve the right to refuse to admit you to the Event or otherwise cancel your participation in the Event if:

  • We have previously banned you for violations of our Terms of Service or any other policies.
  • If you violate the Terms of Service of Tokyo Toybox LLC.
  • Local or national laws or guidelines change with respect to public health or large public gatherings.
  • You fail to comply with mask or social distancing requirements.
  • For any other reason.

Tokyo Toybox reserves the right to amend this Agreement at any time.

Return and Refund Policy

Typically Event Entry CANNOT be refunded. Please understand that entry into Neoparty cannot be refunded for any reason.

You can use store credit to purchase any items in the store, however, store credit, coupons, Tokyo Toybux, and the like CANNOT be used to pay for entry into events or games.


All merchandise returns must be made within 15 days on unopened product with valid receipt and all tags/labels. All other situations will be handled on a case by case basis and may be eligible for exchange credit. All sales are final on the following products: trading card singles, sealed boxes and sets, blind bag/boxes, all food and drinks, all used video games, and all clearance and marked down products.
